      EXCHANGE RULE: Rule 260104.B. Timing of Delivery (Legacy)

      A seller may not schedule delivery of coal earlier than the first calendar day of the delivery month and no later than a date such that there are minimum of seven (7) calendar days remaining in the delivery month. The seller may not complete delivery of coal later than the last calendar day of the delivery month.

      FINDINGS:

      Pursuant to an offer of settlement that Kolmar Americas Inc. (“Kolmar”) presented at a hearing on May 24, 2017, in which Kolmar neither admitted nor denied the findings or rule violations upon which the penalty is based, a Panel of the NYMEX Business Conduct Committee (“Panel”) found that Kolmar failed to timely complete the delivery of seventy (70) June 2015 Central Appalachian Coal Futures (“JUN15 Coal”) contracts to the party CME Group Clearing matched Kolmar with by the last calendar day of the month, June 30, 2015.

      The Panel found that as a result of the foregoing, Kolmar violated NYMEX Rule 260104.B.

      PENALTY:

      In accordance with the settlement offer, the Panel ordered Kolmar to pay a fine to the Exchange in the amount of $40,000.
